Terms and conditions
Once you have selected a program, please carefully review the terms and conditions as your booking is subject to the provisions outlined below. Making a payment for any program or tour offered by KAWSAY PERU TRAVEL signifies your consent and agreement to abide by all the terms and conditions stated herein, which shall be binding for all tours.
General Information
- The program itinerary is subject to change based on weather and river conditions, as well as the preferences of the group.
- Kawsay Peru Travel cannot be held liable for any loss or damage to personal belongings of the client, nor the resulting consequences.
- We are not responsible for any illness or accidents that may occur during the tour. In the event of sickness or an accident, the client bears full responsibility for any associated costs.
- The client assumes responsibility for any equipment loaned to them and agrees to compensate for any loss or damage upon returning to Cusco.
- The client acknowledges and affirms their physical and mental fitness. Kawsay Peru Travel cannot be held responsible for any consequences if this declaration is untrue.
Booking Procedures
Prior to making any payment, please contact us for further assistance. To secure your chosen program, a 50% deposit per person is required at the time of booking. Please note that this deposit is non-refundable in the event of client cancellation. By proceeding with the payment, you enter into a contractual agreement with KAWSAY PERU TRAVEL, and we will subsequently accept and confirm your booking. Please be aware that travel arrangements are considered confirmed only upon written confirmation from KAWSAY PERU TRAVEL.
You may make the 50% pre-payment through WESTERN UNION, PAYPAL, or online payment methods, ensuring the transfer is made in the name of a staff member of KAWSAY PERU TRAVEL. Please note that any bank taxes and transfer costs are the responsibility of the client.
Payment of Final Balance
The program price is quoted in U.S. dollars. We kindly request that you settle your final balance at our office no later than 24 hours before your tour begins. Currently, we accept cash (Peruvian soles or American dollars) and Visa payments (with an 8% commission charge). The program price per person, as agreed upon during the booking confirmation, will remain unchanged.
Cancellation by the Client
If you wish to cancel your reservation, please notify KAWSAY PERU TRAVEL in writing. It is important to understand that the deposit is non-refundable. When providing the reason for cancellation, please note that you may be covered by your insurance policy.
In the event of cancellation received more than 15 days prior to departure, the client will forfeit the 50% deposit. If cancellation occurs between 15 and 7 days before departure, a 50% refund of the tour price will be granted only if 100% of the payment has been made in advance. For cancellations made less than 48 hours before departure or in the case of canceling only a portion of the tour, no refund will be provided.
Cancellation / Changes by us
In the event of circumstances beyond our control, such as technical issues, weather conditions, strikes, riots, or government decisions, KAWSAY PERU TRAVEL will make every effort to propose alternative solutions or comparable travel arrangements to operate the program. However, refunds will not be provided. We reserve the right to modify the scheduled itinerary accordingly, while ensuring reasonable efforts to provide the booked program arrangements.
If significant changes are necessary, we will endeavor, whenever possible, to inform you prior to the departure date and offer comparable alternative arrangements. Any additional expenses incurred as a result will be the responsibility of the client. Please note that KAWSAY PERU TRAVEL cannot reimburse additional expenses incurred by the client in preparation for the tour, including international tickets, fees, visa costs, immunizations, and others.
Cancellation by Kawsay Peru Travel will result in a full refund of your payment.
Acceptance of Risk
Some itineraries provided by KAWSAY PERU TRAVEL are designed to expose participants to the true nature of the visited environment. Consequently, they involve inherent personal risks that could lead to physical or emotional injury, paralysis, death, or damage to the client, their property, or third parties. By participating in the tour, the client acknowledges and accepts these risks as an inherent part of the experience. The client further acknowledges their awareness of their physical and health condition and, based on this knowledge, willingly assumes these aforementioned risks. The client releases KAWSAY PERU TRAVEL from any responsibility in the event of accidents or injuries.
Authority on Tour
The guide or representative of the company holds the final decision-making authority on all matters concerning the safety and well-being of the tour group. It is imperative for participants to follow the instructions of the guide at all times.
The client must strictly comply with the laws and regulations regarding drugs in Peru. Failure to comply with these regulations or any actions that jeopardize the well-being of the group may result in the guide or company representative ordering the client to leave the tour without any refund.
Travel Documents
The client is required to possess a valid passport, and it is essential to carry the original document or a copy during the tour.
Travel Insurance
We strongly recommend obtaining comprehensive travel insurance that covers accidents, medical expenses, emergency repatriation, including rescue and air ambulance services. It is also advisable to ensure coverage for trip cancellations and loss of luggage.
Third Party Services
While KAWSAY PERU TRAVEL operates some services included in the program directly, we also collaborate with airlines, hotels, and other independent providers to deliver the travel services you have purchased. While we maintain quality standards, please note that these parties are independent suppliers, and we have limited control over their operations. Therefore, KAWSAY PERU TRAVEL cannot accept liability for any losses, damages, inconveniences, delays, and other issues caused by these independent suppliers.
Claims and Complaints
If a client has a complaint against the company, it is necessary to inform the guide during the tour for prompt resolution. Any further complaints must be submitted in writing to the company within 7 days after the tour concludes.
All claims or disputes shall be exclusively resolved in Cusco, Peru, and the courts of Cusco, applying Peruvian Law, shall have exclusive jurisdiction.
Claims for damages against KAWSAY PERU TRAVEL are limited to the value of the particular item in dispute. Any liability is further restricted to the total price paid for the tour. The company explicitly excludes all liability for indirect, incidental, or consequential loss or expenses, including loss of profits.
